1. Using WhimAway
You may use the current free WhimAway application for lawful personal task management. You are responsible for the accuracy of information you provide, protecting access to your account and devices, and activity performed through your account.
2. Acceptable use
You must not use WhimAway to:
- break the law or violate another person's rights;
- upload content you do not have the right to use;
- harass, exploit, defraud, or harm others;
- distribute malware or interfere with the service or its providers;
- bypass access controls, security protections, or reasonable usage limits;
- use automated means to overload, scrape, or abuse the service.
3. Your content
You keep ownership of task text, photos, voice recordings, and other content you provide. You grant the operator a limited, non-exclusive license to host, copy, transmit, synchronize, and process that content only as reasonably needed to operate, secure, support, and improve the functionality of the service. This includes sending photo, audio, or transcript content to service providers when you use AI-assisted features.
You represent that you have the rights and permissions needed for content you submit, including content that contains information about other people.
4. AI-assisted features
Photo and voice features can use automated systems to suggest task titles, details, subtasks, dates, or recurrence settings. Suggestions may be incomplete, inaccurate, or unsuitable. Review and edit every suggestion before relying on or saving it, especially for important, time-sensitive, health, legal, financial, or safety-related tasks. AI-assisted processing requires an internet connection and depends on third-party services.
5. Availability and third-party services
WhimAway depends on your device, network connection, notification settings, Firebase, Railway, OpenAI, Apple, Google, and other platform services. Cloud synchronization, reminders, sign-in, account deletion, or AI suggestions may be delayed, interrupted, or unavailable. The service may be changed, suspended, or discontinued, and no uninterrupted or error-free availability is promised.
6. WhimAway intellectual property
WhimAway's software, product design, branding, documentation, and other service materials are owned by Sai Pranith Bhagavatula or used with permission. These Terms do not give you a right to copy, redistribute, reverse engineer, or commercially exploit those materials except where applicable law expressly permits it.
7. Suspension and termination
Access may be limited or suspended when reasonably necessary to address abuse, fraud, security risks, legal requirements, or material violations of these Terms. You may stop using WhimAway at any time. Signed-in users can request account deletion from Settings → Delete Account. Account deletion is described in the Privacy Policy and may require connectivity or reauthentication.
8. Disclaimers
To the extent permitted by law, WhimAway is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
9. Limitation of liability
To the extent permitted by law, the operator will not be liable for indirect, incidental, special, consequential, or punitive losses, or for lost data, profits, opportunities, or business arising from your use of or inability to use WhimAway. The operator's total liability for claims relating to the current free service will not exceed the greater of the amount you paid for WhimAway in the 12 months before the claim or US $25. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
10. Changes
These Terms may be updated as WhimAway changes. Material updates will be reflected by a revised effective date and, where appropriate, additional notice. Continued use after updated Terms take effect means you accept the updated Terms.
